ICASA invites comment on SABC proposals paper

The Independent Communications Authority of South Africa (ICASA) yesterday, Monday, 17 September 2007, issued an invitation to the public and stakeholders to comment on the “must carry” draft regulations as published in the Discussion Document. The SABC proposed earlier this year that successful pay TV applicants be forced to carry SABC channels.

The regulations are made in terms of Section 60 of the Electronic Communications Act, which calls on the Authority to prescribe regulations regarding the extent to which subscription broadcast services must carry, subject to commercially negotiable terms, television programmes provided by a public broadcast service licensee.

The IBA Act had no provisions on the “must carry” regulations, and the Electronic Communications Act of 2005 (ECA) plugs this gap by requiring ICASA to prescribe regulations, and to amend the Subscription Broadcasting Services Regulations.

As a result, the Discussion Document invites interested stakeholders to submit written comments. The closing date for submissions is 4pm on Monday, 29 October 2007 (there will be no extensions).
