Taxi driver sues road agency

A taxi driver has sued the Roads Agency Limpopo for R990 000 after his vehicle crashed off a collapsed bridge over the Lutanandwa River on the Thohoyandou road heading towards Louis Trichardt.

Judge Mohamed Ismail found that the roads agency was 100% liable for damages. Taxi driver Mbulaheni James Mudau, who lives in Itani village near Thohoyandou drove on the road where the bridge had collapsed and crashed into the structure. He fractured several vertebrae and suffered head injuries.

He blamed the roads agency for negligence as it had failed to properly plan for rehabilitation of the bridge or maintenance of the road. He said the roads agency should have immediately repaired the road after the bridge collapsed.

Mudau says that no signs were erected to warn motorists of the hazardous state of the road or the extent of damage to the bridge.
