Lance Davids Case Resolved

The long drawn out dispute between Orlando Pirates FC (“Pirates”) as the complainant and Supersport United FC (“Supersport”) as the respondent pertaining to Mr Lance Davids has finally been resolved amicably between the parties.

The essence of the agreement is briefly as follows:

- The dispute will not proceed before the Dispute Resolution Chamber (“DRC”) of the League, but rather be withdrawn by Pirates (as the party that had initially referred it to the DRC)
- The status quo pertaining to Mr Davids' registration by the League remains,
- Each party to pay their own costs thus far,
- The circumstances and background facts which gave rise to this dispute will be ventilated (correctly so) before the appropriate FIFA tribunal and in accordance with FIFA AGENT'S REGUALTIONS, and both parties have agreed to co operate with each other to the extent necessary and /or required.
- The parties have also issued a joint media statement, which is published in its entirety herein below, for further clarification.

On behalf of the League, DRC Convenor, Mr Zola Majavu, thanked both parties, as well as their legal representatives for the manner in which they resolved this matter.

Below is a joint statement by Orlando Pirates and SuperSport United, regarding the matter.

1. Orlando Pirates Football Club referred a dispute to the Dispute Resolution Chamber of the Premier Soccer League (“the Chamber”) as against SuperSport United Football Club and Lance Davids.
2. Pirates referred the dispute consequent upon the fact that the club had agreed terms with one Rob Moore acting for and on behalf of Ivan Modia, a duly registered FIFA agent, representing Davids.
3. Pirates and SuperSport have investigated the matter to establish the background facts and circumstances giving rise to the dispute.
4. Having assessed the evidence including the communications which passed between the parties, it is apparent that-

  • Neither Pirates or SuperSport knew of the involvement of the other during negotiations concerning Davids;
  • Both clubs were led to believe that the agency was negotiating only with them, in good faith, concerning Davids;
  • Both clubs were furthermore led to believe that they had concluded an agreement in respect of Davids and that Davids would be joining them, and;
  • The aforementioned actions on the part of Moore, acting on behalf of Modia, with Pirates and SuperSport led to the dispute.
    5. To avoid ongoing disputes and differences and adverse implications for the League, Pirates and SuperSport have agreed not to proceed with the dispute before the Chamber each club understanding and supporting the view point of the other.
    6. Pirates are of the view that the issues referred to in point 4 above which gave rise to the dispute between them should be ventilated before FIFA in accordance with the FIFA Agent's Regulations.
    7. SuperSport has agreed to provide all relevant information relating to this matter to FIFA.
